  • 1. Applicability of the Terms of Use

    • These terms of use (Terms of Use) constitute a legal and binding contract between you and Just Event Solutions Private Limited (Company) with regard to the use of

      • Any service that may be provided by the Company using the Website and/or any other Application
      ((a) And (b) above collectively, Services).
    • The Company allows, amongst others, event space providers/ venue managers or owners (Venue) to list their properties on the Website and permits end-users to make venue bookings/reservations at such properties.
    • By subscribing to or using any of our Services you agree that you have read, understood and are bound by these Terms of Use, regardless of how you subscribe to or use the Services. If you do not want to be bound by these Terms of Use, you must not subscribe to or use our Services
    • In these Terms of Use, references to "you" or "your" or "User" shall mean the user subscribing to or using any of the Services and "we", "us", "our" or "JESVENUES" shall mean the Company
    • These Terms of Use are applicable to all the Services. In addition to these Terms of Use and depending on the Services opted for by the User, the User may be required to read and accept or may have read and accepted, additional terms and conditions of service (TOS) for each such Service and/or may be required to execute or may have executed, additional agreements with the Company (Additional Agreements).

  • 2. Modifications/Amendments

    • We may, at any time, for any reason and without assigning such reason and without notice, make changes to, the Website, including its look, feel, format, and Content (defined hereafter); and these Terms of Use.
    • Any such modifications/amendments as provided for in Clause 2.1 above will take effect from the time they are posted on the Website. By your continued usage of the Website upon such changes being posted, you will be deemed to have accepted such changes

  • 3. User Account, Password and Security

    • You must be 18 (eighteen) years of age or older to subscribe to or use any of our Services in any manner. UPON SUBMITTING A BOOKING/RESERVATION YOU REPRESENT AND WARRANT THAT YOU ARE 18 YEARS OF AGE OR OLDER. By subscribing to or using any of our Services, you represent that you are at least 18 (eighteen) years of age, and that you have the right, authority and capacity to subscribe to and use the Services and to create binding legal obligations for any liability you may incur as a result of subscribing to or using the Services.
    • Registration of the User on the Website is optional. If you opt to register on the Website, you will receive a password and user identification upon completing the registration process. You are responsible for maintaining the confidentiality of the password and the user identification, and you shall be fully responsible for all activities that are undertaken through your account. If you register on the Website you agree to:
      • Promptly notify us of any unauthorized use of your password or user identification or any other breach of security in relation to your account; and
      • Ensure that you properly log out/exit from your account at the end of each use/session
      • Provide true, accurate and complete information that may be required to be provided during the registration process on the Website
      • Maintain and promptly update such information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your registration and refuse any and all current or future subscription to or use of the Services
    • JESVENUES reserves the right to deny any User from registering on the Website without assigning any reason therefore
    • When you register with JESVENUES, you authorize us and our partners/affiliates/group companies to contact you from time to time to provide offers/information of services that we believe may be relevant for you.
    • We shall not be liable for any loss or damage arising from your failure to comply with provisions of this Clause 3.

  • 4. Scope of Use

    • You may only use the Website solely to obtain services provided by the Company using the Website and for no other purpose whatsoever.
    • You shall not interrupt or attempt to interrupt the operation of the Website in any way. You shall not intrude or attempt to intrude into the servers hosting the Website in any way.
    • You shall make payments of all amounts to the Company when due in accordance with these Terms of Use, TOS and/or Additional Agreements, including any duties, taxes, fees and/or related charges whether or not included in the amounts quoted on the Website. User shall also agree to pay all duties, taxes, and related charges arising out of its use of the Services
    • In the event that any transaction or attempted transaction relating to JESVENUES which violates these Terms of Use, the Privacy Policy (defined hereafter) or applicable law comes to your knowledge, you shall take all steps to promptly inform JESVENUES of the same.
    • You shall at all times ensure full compliance with the applicable laws and rules and regulations regarding your use of our Services.
    • You are prohibited from: 
      collecting email addresses or other contact information of other Users, through any means whatsoever, without authorization from JESVENUES selling, cross-selling or distributing Services to any third party or allowing multi-user access to the Services by sharing your password and user identification using any automated software, hardware or any other similar mechanism to use access, navigate or search the Website; and posting or transmitting any information on the Website and/or the Mobile Application including unauthorized or unsolicited advertising, promotional materials, or any other forms of unauthorized solicitation to other Users (other than the information specifically permitted/ required to be posted or transmitted under these Terms of Use, TOS and/or Additional Agreements).

  • 5. Intellectual Property Rights

    • The Website and each of their modules, is the copyrighted property of JESVENUES and/or its various third party providers and distributors. The Website contains material, which is protected by copyright and/or other intellectual property rights. JESVENUES reserves all rights in the Website and their content not specifically granted in TOS, Additional Agreements and/or these Terms of Use.
    • Any software that is made available to download from the Website (Software) is the copyrighted work of JESVENUES and/or its various third party providers and distributors. Your use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (License Agreement). You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms. For any Software not accompanied by a License Agreement, JESVENUES hereby grants to you, the User, a personal, non-exclusive, non-transferable license to use the Software for viewing and otherwise using the Website in accordance with these Terms of Use and for no other purpose and such license may be terminated and revoked by JESVENUES at any time for any reason. Please note that all Software is owned by JESVENUES and its suppliers and is protected by copyright laws and international treaty provisions. Any reproduction or redistribution of the Software is expressly prohibited by law, and may result in severe civil and criminal penalties.
    • "JESVENUES", "jesvenues.com", "Whatever the event, we are the solution" and other JESVENUES graphics, logos, taglines and service names are intellectual property of JESVENUES. Except as specifically permitted herein, these shall not be used by the User or any other person without the prior written permission from JESVENUES. All other trademarks not owned by JESVENUES that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by JESVENUES.
    • You may use and display any portion of the content available on the Website (including without limitation text, graphics, software, audio and video files and photos) (Content) only on your personal computer, mobile phone, tablet or other similar personal devise and only for personal use. You may print copies of the Content and store the Content on your personal computer, mobile phone, tablet or other similar personal devise for personal use. JESVENUES grants you a limited, personal, non-exclusive and non-transferable license only for such use.
    • You shall not alter or modify the Content in any way. You shall not use, reproduce, republish, distribute, prepare derivative works, or otherwise use the Content (or any portion thereof) other than as explicitly permitted herein.
    • You shall not remove any: (a) copyright, trade mark or other intellectual property notices from any Content (or from copies and/or print outs thereof); and/or (b) link to the Website from any place, without our express written consent
    • You do not acquire any ownership rights to any Content. Any unauthorized use of the Content shall terminate the permission or license granted by JESVENUES herein.
    • You shall not transfer the Content to any other person except with the prior written consent of the Company. You agree to abide by all additional restrictions in relation to the Content displayed on the Website, as may be updated from time to time.
    • Notwithstanding the above, JESVENUES does not represent or guarantee that it has any right (including intellectual property rights) on the Content including the right to allow use thereof by the Users

    • You hereby consent, express and agree that you have read and fully understood the Privacy Policy and that the terms and contents of the Privacy Policy are acceptable to you

  • 7. Communication Services and Your Information

    • The Website may contain services such as email, chat, inquiry service related to Venue, news groups, forums, communities, personal web pages and/or other messages (Communication Services).
    • From time to time, you shall provide all the information that may be required by the Company from you through the Website
    • "Your Information" is defined as any information you provide to us or any other person through the Website during the registration process, using any Communication Service, at the time of making any bookings/reservations for the Venue. Otherwise You are solely responsible for Your Information, and we act only as a passive conduit for your online distribution and/or publication of Your Information.
    • Please note that in accordance with the Information Technology Act, 2000 and its applicable rules there under, in case of non-compliance with applicable law, these Terms of Use and/or the Privacy Policy in relation to the access or usage of our Website, we have the right to immediately terminate the access or usage rights of any User of our Website and remove any non-compliant information. Without limiting the generality and effect of the foregoing, you undertake that you shall not host, display, upload, modify, publish, transmit or share any information on the Website that: belongs to another person and to which you do not have any rights; is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; harm minors in any way; infringes any patent, trademark, copyright, or other proprietary rights; violates any law for the time being in force; deceives or misleads the addressee about the origin of such messages or communicates an information which is grossly offensive or menacing in nature; impersonate another person; contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
    • In order to enable JESVENUES to use Your Information, so that we are not violating any rights you may have in Your Information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to use Your Information, in any media now known or that may come into existence in future
    • Without prejudice to our rights under Clause 7.5 above, to the extent required or permitted by applicable law, we may also collect, use and disclose Your Information in connection with security related or law enforcement investigations or in the course of cooperating with authorities or complying with legal requirements
    • You shall solely be responsible for any Loss that may be incurred by any person as a consequence of use of/ reliance on Your Information and you agree and undertake to indemnify and hold harmless, the Company, its employees, officers, affiliates, partners and group companies from all such Losses.
    • "Loss" for the purposes of these Terms of Use means each loss, damage, fine, penalty, cost, expense or other liability (including legal and other professional fees) and Losses shall be interpreted accordingly.

  • 8. Third Party Websites

    • 1he Website may be linked to other websites on the World Wide Web that are not under the control of or maintained by JESVENUES. Such links do not indicate any responsibility or endorsement on our part for the external website concerned, its contents or the links displayed on it. JESVENUES has no responsibility or liability for and makes no representations whatsoever about any other website that you may have access to through our Website. These linked sites are only for your convenience, and therefore, you access them at your own risk.
    • JESVENUES shall not be liable for any Loss associated with your use of such other websites. JESVENUES seeks to protect the integrity of its Website and the links placed upon it, and therefore requests any feedback on not only its own Website, but also third party links. JESVENUES reserves the right, at its sole discretion, to terminate any link or linking program at any time and for any reason it deems appropriate.

  • 9. Exclusions

    • Your use of the Website is at your own risk. Everything on the Website including the access to listing of and information about any Venue are provided to you on an "as is where is" basis and without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The entire risk as to the results and performance obtained from using the Content is assumed by you.
    • The Venue and other suppliers providing services listed on the Website are third parties obtaining services from JESVENUES as an independent contractor and not agents or employees of JESVENUES. JESVENUES is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such third parties or for any personal injuries, death, property damage, or other damages or expenses resulting there from.
    • The Website and the Content contained therein could include technical or other inaccuracies or typographical errors. You agree and acknowledge that much of the Content on the Website is provided and/or uploaded by third parties. JESVENUES makes no representations or warranties as to the completeness or accuracy of Content. JESVENUES makes no commitment to update or correct the Content that appears on the Website.
    • JESVENUES makes no representations about the suitability of the information, software, products and services contained on the Website for any purpose, and the inclusion or offering for sale of any products or services on the Website does not constitute any endorsement or recommendation of such products or services by JESVENUES. All such information, software, products, and services are provided on an "as is where is" basis without warranty of any kind. JESVENUES disclaims all warranties, conditions and liability with regard to this information (including, without limitation, photographs, list of amenities and descriptions of Venue), software, products, and services including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement.
    • Information is supplied upon the condition that the persons receiving the same will make their own determination as to its suitability for their purposes prior to use or in connection with the making of any decision.
    • Without prejudice to generality of the above, JESVENUES does not confirm or guarantee any accuracy of the ratings provided to the Venue listed on the Website and the same are provided solely for the convenience of the Users.

  • 10. Limitation of Liability

    • The liability of the Company under these Terms of Use and/or otherwise in relation to the Users’ subscription to or use of any of our Services shall be limited and not exceed the payments specifically required to be made by the Company under these Terms of Use, TOS and/or any Additional Agreements. The Company disclaims all warranties, express or implied, with respect to the obligations performed under these Terms of Use, TOS and/or any Additional Agreements.

  • 11. Confirm the Booking/ Reservation Procedure

    • Payment - The Company may require the Users attempting to make bookings/ reservations at the Venue to make full or part advance payment of the tariffs and other charges. The credit card, debit card, bank account or other similar mode of payment of the Users will be charged such full or part advance payment as indicated on the Venue’s final payment page on the Website at the time of the booking/reservation. The availability and the tariffs and other charges stated on the listing page and/or final payment page are indicative and the actual tariffs and availability can only be confirmed after JESVENUES has received the payment. You hereby agree and acknowledge that the tariffs and other charges for Venue stated on the Website subject to change at the respective Venue's discretion and JESVENUES shall not be responsible for any increase/change in the tariffs and other charges provided by Venue.
    • Booking Confirmation - The confirmation e-mail and SMS will be provided to you to the e-mail ID and mobile number provided by you while you making the payment on JESVENUES.com to confirm the booking. Upon confirmation of the booking/reservation, you shall be deemed to have entered into a direct contract with the Venue (Booking Contract) and the information provided to you through the Website at the time the booking/reservation is concluded including the cancellation policy, Venue’s other terms and conditions, tariffs and other charges shall constitute an integral part of the Booking Contract and you shall be bound by the same. The Company shall not be a party to the Booking Contract and shall not have any liability/ obligation under or in relation to the Booking Contract whatsoever.
    • Non-availability/ cancellation/ dishonor of booking/reservation - In case of the requested Venue not being available for your requested event duration or in case of the cancellation/dishonoring of your confirmed booking by the Venue except in accordance with these Terms of Use, JESVENUES will make efforts to find other Venue in the same city that are available for the requested event duration and you may be accordingly intimated. If you agree to take such alternate Venue (and agree to bear the increase in tariffs and other charges applicable thereto, if any), a new invoice will be generated for such alternate Venue and you will be deemed to have originally requested for such Venue and the provisions of these Terms of Use shall apply accordingly. If you decide to cancel such request for booking/reservation because of non-availability/cancellation/dishonoring of the requested Venue as above, then the whole amount paid by you to JESVENUES for such booking/reservation will be refunded to you as per our refund policy.
    • Cancellation of Bookings - You can cancel any bookings/reservation made through the Website only in accordance with the Venue’s and Company’s cancellation policies.
    • Refunds - While JESVENUES will endeavor to provide remittance instructions to its bank(s) to make the refunds, within 3 (three) business days from the date on which such refunds become due in accordance with these Terms of Use, JESVENUES does not guarantee the time it will take for the bank to process the refund and for you to receive the same. The refunds will be made by JESVENUES through the same means/mode of payment which was used by you to make the relevant payment to JESVENUES.
    • General - JESVENUES at its sole discretion reserves the right to accept or reject the instructions for booking/reservation placed by the User through the Website without assigning any reason thereof. The services rendered by us are different and separately distinguishable from the services provided by the Venue to you. By making the required payment to JESVENUES for booking/ reservation at the Venue, we act as your pure agent for making payment of such amounts (reduced by any fees payable by the Venue to JESVENUES) to the Venue i.e. we recover the actual cost to be paid to the Venue, as a reimbursement, in addition to our fees payable by the Venue and you authorize us to make payment on your behalf to the Venue for services to be provided by the Venue to you. JESVENUES does not hold or intend to hold the title to the services provided by the Venue to you. All the expenditure or costs incurred by us in the course of providing any services to you are incurred by us in the capacity as your pure agent. You would occupy the Venue booked/reserved by us on your behalf and in the event of non-occupancy by you; we shall not occupy the Venue so booked/reserved or offer the same to other customers who visit our Website or Mobile Application. While we collect payments from you and make payments as your pure agent to the Venue in accordance with this Clause 11.6(c), the legal responsibility for making payments for such services rests with you (including in the unintended event of our failure to remit such payments to the Venue). If you make any specific/special requests such as seating style, buffet arrangement or category of smoking/ non-smoking, we will endeavor to request the Venue and they may agree, however, neither JESVENUES nor the Venue guarantees that your request will be honored. Venue may from time to time and at their sole discretion change their terms and conditions and these terms and conditions will be available on the Website. However, it is advisable that you independently and directly with the Venue inquire about any specific queries you may have regarding the Venue’s terms and conditions. The Venue reserve the right of admission. Some Venue may not allow outside vendors like event organizers/managers, decorators, food and beverages from outside, liquor, DJ. The primary guest must be at least 18 (eighteen) years old to be able to book/reserve the Venue. The Venue may deny your booking/reservation in case of your failure to comply with any of Venue’s terms and conditions or requirements of applicable law.

  • 12. Fees, Payments and Tax

    • JESVENUES reserves the right to charge listing fees for certain listings, as well as transaction fees on the bookings/reservations made using the Website. We reserve the right to alter any and all fees from time to time, without notice.
    • In case, there is any short charging by JESVENUES for listing or transaction fees or any other fee because of technical or other reasons, JESVENUES reserves the right to deduct/charge/claim the balance subsequently at its own discretion.>
    • JESVENUES currently accepts payments through: (a) Indian and international credit cards and Indian debit cards; (b) internet banking of certain banks in India; and, (c) electronic wallets of service providers authorized by RBI. In cases of bulk bookings and in other cases that JESVENUES deems appropriate, JESVENUES may accept payments through cheques issued by banks in India or in cash. JESVENUES may from time to time and in its sole discretion agree to accept payments through such other modes as JESVENUES may deem appropriate. All payments must be made in Indian Rupees. Current billing address, phone number and other information demanded on the Website must be included with every request for booking/ reservation
    • By booking with JESVENUES, you authorize JESVENUES and its agents to transact with your bank or other payment gateways to obtain necessary information required to process payment, confirm payment, resolve inquiries and billing disputes and/or as otherwise required to manage the booking/ reservation. You must adhere to the terms and conditions that are prescribed by the payment gateways through which you choose to transact. JESVENUES shall not be responsible for any Losses incurred by you while transacting through these payment gateways.

  • 13. Indemnity

    • You agree to indemnify, defend and hold harmless JESVENUES, its employees, attorneys and agents, from and against any and all Losses asserted against or incurred by JESVENUES that arise out of, result from, or may be payable because of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms of Use, TOS and Additional Agreements or any other liabilities arising out of your subscription to or use of the Website.

  • 14. Maintenance of Website

    • JESVENUES shall not have any obligation to ensure availability of the Website including during periodic maintenance operations and/or any unplanned suspension of access to the Website that may occur due to any technical reasons or any other reasons. The User understands and agrees that any material and/or data downloaded or otherwise obtained through the Website is done entirely at its own risk and that JESVENUES will not be responsible for any Loss to the User’s computer systems or loss of data that results from the download of such material and/or data

  • 15. Term and Termination

    • Subject to the provisions of this Clause, these Terms of Use shall remain in full force and effect while you use any Service in any form or capacity.
    • JESVENUES may suspend or terminate your use of the Website at any time in its sole and absolute discretion without serving any notice. Without prejudice to JESVENUES’s rights under these Terms of Use to suspend or terminate your use of the Website without any reason or for other reasons specified elsewhere in these Terms of Use, JESVENUES may suspend or terminate your use of the Website without any notice if it believes, in its sole and absolute discretion that: you have breached, violated, abused, or unethically manipulated or exploited any provisions of these Terms of Use, TOS and/or Additional Agreements or have otherwise acted in an unlawful or unethical manner; the information/details provided by you cannot be verified or authenticated; your actions may infringe on any third party rights or otherwise result in any liability for JESVENUES and/or other Users.
    • JESVENUES reserves the right to recover any amounts due and owing by the User to JESVENUES and/or any Venue and take any legal action for recovery thereof as it deems necessary.
    • Upon suspension or termination of your use of the Website, you shall have no right and we shall have no obligation thereafter to execute any of your uncompleted tasks or forward any unread or unsent messages to you or any third party. Once the User's registration or the Services are suspended or terminated, any data that you may have stored on the Website may not be retrieved later. In such an event, JESVENUES shall not be responsible or liable for any loss or damage that may be caused to you as a consequence of such suspension or termination.
    • Once the User has been indefinitely suspended or terminated, the User may not register on the Website or use the Website in any manner whatsoever unless specifically permitted JESVENUES.

  • 16. Governing Law and Jurisdiction

    • These Terms of Use are governed by and constructed in accordance with the laws of India and any disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Hyderabad.

  • 17. Miscellaneous

    • Separate Agreements - You may execute/accept or may have executed/accepted Additional Agreements/TOS with JESVENUES. Those Additional Agreements/TOS are separate and in addition to the terms given in these Terms of Use. These Terms of Use do not modify, revise or amend the terms of any Additional Agreements/TOS that you may have accepted/executed with JESVENUES.
    • Safe Harbor - Any statements contained in the Website concerning JESVENUES's future prospects are forward-looking statements which involve a number of risks, uncertainties and other factors that could cause actual results to differ materially from those that may be projected by these forward looking statements. There can be no assurance that future results will be achieved and actual results could differ materially from forecasts, estimates and summary information contained in the Website.
    • Disputes with Venue - You are solely responsible for your interactions with the Venue and/or other Users. JESVENUES reserves the right, but has no obligation, to intervene in any disputes between you and the Venue and/or other Users.
    • Severability - If any provision of these Terms of Use is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms of Use shall continue to be in full force and effect
    • Headings - The headings used in these Terms of Use are included by convenience only and will not limit or otherwise effect these Terms of Use.
    • Inquiries, Contact and Notices - All notices, communications and inquiries regarding a commercial relationship with JESVENUES, relating to any aspect of the Website and/or under these Terms of Use shall be in writing and:

      • For the User, should be directed to the email address provided by the User on the Website.
    • Grievance Officer - The name and the contact details of the Grievance Officer appointed in accordance with the Information technology (Intermediaries Guidelines) Rules, 2011 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Date or Information) Rules, 2011 and the mechanism for notification of complaints to the Grievance Officer are as follows:
